 Update June 2010

 

 

Just another calamity month at Frankland Prison for me. It would appear Frankland have once again lost my mail. Currently I have over 20 letters lost within this prison.

 

Further to the above, I posted three letters out to the BBC, a senior crime correspondent for a major news paper and Private investigator. Frankland Prison for some unknown reason posted all three without affixing the appropriate fee for postage, irrespective that I affixed the payment form to be deducted from my private cash.

 

Simon Creighton my Prison Law Solicitor has lodged a second Judicial Review in relation tot eh Parole Board refusing to discuss at an Oral hearing the reasons for refusing to progress me through the system.

 

Last week my Facebook page was shut down as a result of a complaint. Obviously from someone who takes offence to the 1200 people who support my plight, to include a high number of celebrities. Nevertheless, we have another one up and running and it currently stands at just under 500. Thanks to all those who support me.

 

It would appear the Prison Service are considering removing the facility to print letters and have inferred that I will now have to burn my letters onto disk and subsequently post the same out to my solicitor. Put simply this is totally unpractical for a number of reasons. A solicitor would have to employ a full time secretary to deal with the amount of mail that I have to reply to in relation to my conviction.

 

Also, last week I went on to a visit and found to my dismay that I was to be seated in what was a room for sex offenders and such and was duly informed that the visiting area was now integrated. I ask you, who in there right mind would wish to sit amongst such beasts when you have women and children visiting you. It further appears that my somewhat vocal objection to this whilst referring to them as the “Beasts” they are, has caused offence to management and I have been advised that I must tone down my objections.

 

It appears my case is attracting the right interest again and I currently have a number of significant contacts looking to assist me with my conviction. I hope to have more news in relation to this next month.

 

Louise Shorter formerly the Assistant producer for Rough Justice is currently in discussions with a forensic expert in relation to providing his expertise in an area of evidence used to convict me. I have always contested this ominous evidence. I shall fully inform you when I am able too. Thank you Louise X you have never forgotten me.

 

The piece I wrote for author Robin Barratt in conjunction with the new Charlie Bronson book entitles “RESPECT & REPUTATION” is now on sale and the following facts will bring awareness to my case.

 

I am a 41 year old man entering my 15th year in prison for a crime I did not commit. I have always maintained that I am a victim of a terrible miscarriage of justice and that the leading investigator and disclosure officer in my case, Detective Inspector Spackman fabricated evidence with Police informers Roger Vincent and David Smith and withheld other vital evidence to secure my conviction.

I was arrested and subsequently convicted of slaying Robert Magill in a Hertfordshire lane in 1994. The back ground to the case is that 44 year old Robert Magill was walking his dog at 8:15am on the 13th October 1994 in rural Chorleywood, Hertfordshire, when he was ambushed by two gunmen who pumped 5 rounds from a pump action shotgun into him. Mr Magill died instantly.

 

Also, it is reported that during the trial of Roger Vincent for the murder of David King, that it was raised in open court that Vincent was a Police informer. I hope to obtain the transcript of this statement to bolster my case along with irrefutable material from agencies within the Criminal Justice System that confirm the same, in that, I have always maintained Vincent fitted me up with his Police handler Spackman to ensure both he and Smith walked free. You can never have enough material like this.

I have received another offer for my biography in relation to my wrongful conviction. Naturally I need to discuss this further with the Publisher in question.

 

Kevin Horner is still campaigning for me and placing Innocent banner in various places around Scotland. Good man Kevin. I am writing to you as we speak.

 

Frankland currently have a fitness test running for prisoners. You have to row 250 meters in 45 seconds with a 30 second rest and you have to complete 5 sets. I had a test run and after I had just done a circuit. I completed 3 sets, 2 under 43 seconds and the third set in 44 seconds. It is hard and I am the only one to manage three sets to date. However, I feel confident that I can do all five after the test run and will try soon.

 

I have also written to Mathew Elliott of the Tax Payer Alliance to illustrate the contempt and total disregard for the taxpayer and his or her hard-earned money that was displayed within the higher echelons of Hertfordshire Constabulary during the 2004 review of the 1994 investigation (the murder of Robert Magill Operation Cactus) that resulted in my wrongful conviction.

 

At paragraph 7.9 it report “that the SIO in charge of the original case, Detective Superintendent Whinnett refused to co-operate with the review team”. Although the review author also adds that no

inference should be placed on this, you don't have to be a conspiracy theorist to draw any obvious inferences from any of this.

 

 

A legitimate inference from the taxpayer would be “hold on a minute, this review is funded by the taxpayer and yet we have a situation, in which, a senior member of Hertfordshire Constabulary is refusing to co-operate with a review commissioned by a senior colleague on behalf of the Constabulary that pays their wages”?

 

It is understandable even though it may be considered somewhat distasteful when a police officer who is subject to an investigation refuses to co-operate with the investigation and I am sure you will agree that no such review code hope to achieve full satisfactory closure without the input/co-operation of the head of the prior investigation now under review.

 

I suppose Hertfordshire Constabulary or Detective Superintendent Whinnett may argue that the review was funded by the police budget or such because the review team consisted of two serving Hertfordshire Police Officers. That police budget is funded by the taxpayer and the review team would have served the public better by attempting to protect the old, women, and children rather than waste time and money by working on a review that would never achieve satisfactory closure without the co-operation of Detective Superintendent Whinnett.

 

I wait a response from Mr Elliot.

 

Also, if anyone knows a member of the Magill family, please can you ask them if they received the letters and material for their consideration? I am of the opinion that they have a case against Hertfordshire police and my letters and enclosures will highlight this.

May 2010 Update

 

The Prison Service has conducted a screening test in relation to Kevin’s dangerousness to society and committing further crimes. It was conducted in relation to a Judicial Review Kevin’s solicitor: Simon Creighton lodged in respect of Kevin’s Category A and the failing of the Prison Service to downgrade him. One of the questions Kevin was asked was to explain why he had a fight when he was 15 with a boy who was several years older than Kevin and from another area.

 

Kevin’s Judicial Review in relation to his Category A was submitted on the 25 November 2009. Simon Creighton has written to the court to enquire what the delay is on the first judge considering his case.

 

The CCRC has appointed a new case review manager to his case as a result of his last review manager David Robinson leaving. Although Kevin is somewhat disappointed with this development after nearly three years, Kevin has had discussions with his new manager who Kevin says ahs a very warm honest and genuine nature.

 

Subsequently, Kevin has submitted a request to a private investigator and leading journalist to conduct an interview with a separate witness. If this proves successful it will have significant effect on the review currently being conducted by the Criminal Cases Review Commission.

 

Guy Ritchie, Liam Gallagher, Ricky Hatton, Howard Marks and Cheryl Cole to name but a few have also joined the ever growing list of celebrities who support Kevin’s campaign for his conviction to be overturned.

 

Tony and Martin Bowers of the Peacock Boxing Gym have arranged of a new style of INNOCENT T-shirts soon to be ready for anyone who wants them.

 

Kevin Horner, a campaigner for Kevin placed a large banner in Kilmarnock Town Centre. Kevin intends to move the banner frequently. Thanks Kevin.

 

The author and film writer, Cass Pennant, has forwarded material onto his publisher in connection to Kevin for their consideration.

Maslen Merchant, Kevin’s criminal lawyer, has successfully brought awareness to Kevin’s plight by way of running his Facebook. To date Kevin currently has over 1,100 friends. Maslen has further ideas in relation to bringing awareness to Kevin’s case that he will soon put into action.

 

Daniel McCulloch and the members of the Howard League for Penal Reform are continuing to campaigning for Kevin. They already have hundreds of members signed up to The Miscarriage Of Justice page that they have set up within the last month.

 

Terry Filed, a former prison officer from Whitemoor and now author is currently writing a book about Whitemoor and events therein. We have been informed that Kevin will feature in Terry’s book. We are chuffed to learn about this as it portrays Kevin in the manner that everyone who knows him for, in that, Terry is not the first Prison Officer to leave messages on Kevin’s website in support of his wrongful conviction. It must say something about Kevin when people employed to contain Kevin write in support of him.

 

A sponsored walk to, 10 Downing Street, is currently being organised for hopefully January 2011. It will consist of a 40 foot low loader truck with a boxing ring on and a cage in the ring. The ring and cage will contain a number of celebrities who have signed up to Kevin’s campaign.

 

Kevin has just read his favourite book of all time “Pillars of the Earth” by Ken Follett and he recommends it to anyone who likes a good read. He now intends to read Wothering Heights, by Emily Bronte.

 

In the month of April Kevin’s postal costs amounted to almost £200.

 

Ian Cordingley recently delivered four new banners for Kevin to have hung in various places around the country. Thank you Ian.

 

Robin Barratt will be launching his new book in June at Waterstones up and down the country in which Kevin has written a piece on Respect and Reputation and how prisoners should behave when they first come into prison.

 

Kevin has also been asked to contribute a piece for a second independent book to be released this year. The title and such will be named if his piece is launched.

 

The journalist and author, David Leslie is currently working on an article in collusion with Paul Ferris in relation to Kevin’s wrongful conviction.

 

Kevin’s criminal lawyer, Maslen Merchant, was recently contacted by a witness in respect of information he has in respect of Kevin’s wrongful conviction. The witness is so convinced of Kevin’s innocence he is prepared to go live on national television to say what he knows. Sally Chidzoy of BBC Look East is currently looking into whether or not the cost of a further piece by the BBC can be justified.

April 2010 Update

 

Kevin's case review manger at the Criminal Cases Review Commission, David Robinson, is leaving after nearly three years of investigating Kevin's case. The CCRC are appointing a new case review manager shortly.

 

Solicitor, Simon Creighton, successfully forced the Prison Service to allow Kevin to post letters out of prison in relation to Roger Vincent and David Smith being informers. Previously the prison service's stance was that Kevin could receive mail naming Vincent and Smith from media contacts but subsequently wold not allow Kevin to reply if he mentioned Vincent and Smith's names. Luckily, this was for a relatively short period of time before Mr Creighton was successful in his application.

 

Kevin's Category A review is currently being considered locally by Frankland Prison. Their decision will then go to Prison Service Headquarters.

 

Further to the above. Kevin's Category A Judicial Review is pending at the High Court in relation to challenging the previous two years decision to keep Kevin category A. We currently wait a date for the High Court judge to decide if Kevin's case has merit!

 

Simon Creighton informed Kevin that another client of his with exactly the same went in front of a single judge and was found to have merit. This application from start to finish lasted two weeks. Kevin has been waiting five months.

 

The Prison Service has asked Kevin to sit a number of screening tests in relation to a course they wish Kevin to complete. Kevin has already been assessed twice since 2005 and was found not suitable. Kevin suspects the Prison Service feel Kevin is suitable for the intended course.

 

During the screening process it became apparent that there were a number of discrepancies in terms of factually recorded details about Kevin that were incorrect. However, in the meantime the Screening test is still to be analyzed by psychologists irrespective of the apparent mistakes.

 

It is worthy of mention that Kevin does not meet the set criteria for this course and both Simon Creighton and Kevin find this latest move, put simply, just another stumbling block to keep Kevin in prison longer.

 

Daniel McCulloch and the branch members of the Howard League Society are raising awareness to Kevin's conviction in the next few months. Kevin hopes that they will also be successful in their investigations in relation to informers information that Roger Vincent supplied to Hertfordshire Constabulary and the handling of the same by the CPS at the time of Kevin's trial.

 

Daniel will hopefully be posting a number of diary entries Kevin has penned over the years on Bloggs.

 

In the week 22 February Kevin posted over 2000 pages of information out of Prison to 23 Media contacts and such.

 

We have five more INNOCENT Banners going up around Coventry. Liverpool, Kilmarnock and Manchester will be the latest.

 

 

 

In one week Kevin works on his case an average of 30 hours on the lap top as well as researching the law and preparing case papers to be forwarded to various contacts. You must bear in mind that Kevin works in the prison gym every day, so most of the work he does takes place when he is locked up during the day for short periods then late at night.

 

Kevin rarely has a Television because of the work he puts into his case. Every six weeks or so Kevin will watch TV for one or two nights to recharge his batteries.

 

Friday, Saturday and Sunday he is locked up at 4:25pm until 8:15am the next morning. This allows Kevin a good period of undisturbed work where he usually manages 6 hours or more each night sat in his chair either staring at the lap top or reading.
